Just about to receive my w2 ?

Just finally found my old boss from 3 months and told him I didn't get my w2. I was unable to file it cause he mOved back to Virginia from California after the store closed. Can I even still file it. Should I tell him I want compensation for the 3 months being late. Also the last two of my paychecks bounced and I was negative in my account. Got charged over draft fees. If I do ask for compensation how much should I ask for and can I file my tax return now
